Alban Gervaise case: Criminal irresponsibility in the face of a family tragedy

31 July 2025

Alban Gervaise was stabbed to death in Marseille in May 2022 while he was in his car with his 20-month-old daughter, waiting for his two other children in front of their school. The Aix-en-Provence Court of Appeal ruled that the murderer was not criminally responsible, following the conclusions of three experts who had been consulted and who concluded that he was not of sound mind at the time of the incident. Christelle Gervaise lodged an appeal, represented by the law firm Briard & Bonichot.

In two articles published in Le Point and Le Figaro, and in an interview for Ici Provence, Stéphane Bonichot, partner lawyer, revisits the case, the legal issues raised, and the need for lawmakers to change the law.
